- Written notice within 10 days of signing this agreement is required in order to cancel my registration and receive a full refund (minus Beginner Kit). There will be no refunds or cancellations provided after 10 days of signing this agreement. For my second month of training and onwards, I must cancel 14–30 days before my next payment. Refunds will NOT be provided for cancellations made less than 14 days before the payment due date, on the due date, or after the due date.
- Uniforms and merchandise are final sale. No returns or exchanges are allowed.
- I understand that exam fees are not included in tuition and must be paid separately.
- All fees already reflect School closures and holidays, which are not owed to me. Closures and holidays do not need to be made up as make up classes.
- Any classes that I miss, for which the School is open, are my responsibility and can be made up in person or online; however it is not the responsibility of the School to provide makeup classes. Payment will not be moved nor discounted, nor credit provided, in case of missed classes.
- The School shall not be liable for cancellation of classes attributable to war, fire, flood, weather, acts of God, pandemics, acts of third parties, terrorism, acts of governmental authorities, accidents, work stoppage, riot, and disobedience, equipment breakdown or other measures beyond our reasonable control. The School will provide classes to the best of its abilities in these situations. No requests for refunds will be honoured due to these circumstances.
- I understand that my payment is non-transferrable for another student's use.
- I understand it is my responsibility to communicate any physical, emotional, mental, or psychological concerns that may prevent me from taking part in classes and training activities. I confirm I am physically, emotionally, and mentally able to perform every chosen activity. I am fully aware of the risks and hazards connected with the participation in Karate, Sparring, Kickboxing, Kobudo, Arnis, Aerobics, Fitness, including physical injury, illness, or death, including but not limited to falls and injuries sustained as a result of contact with other participants. I herby elect to voluntarily participate in said event, knowing that the associated physical activity may be hazardous to me and my property.
- You may select YES or NO · I agree that my likeness and image and/or the Student's likeness and image may be digitally recorded in a photo or video ("Digital Images") by or on behalf of the School during classes and events. I agree that the School may publish, reproduce, broadcast, communicate by telecommunication (including but not limited to the Internet), exhibit, distribute, adapt and/or otherwise use or re-use all of the Digital Images in connection with the promotion, advertising and exploitation of the School's products or services. All persons will remain anonymous in all Digital Images.
- LIABILITY, WAIVER AND RELEASE · The Buyer (and Minor) understands and acknowledges strict observation of the School's rules and regulations. The Buyer (and Minor) understands and agrees that the use of the School's facilities and the Buyer's (or Minor's) presence at the School are at the sole risk of the Buyer (and Minor). The Buyer, individually (and on behalf of Minor) acknowledges that every effort is made for the safety of the Buyer (or Minor). The Buyer (and on behalf of Minor) acknowledges that martial arts training, programs, and events, has the potential for accidents, serious injuries, illness, or death. The Buyer, individually on behalf of him/herself, (and Minor) and anyone claiming by or through the Buyer (and Minor), hereby agrees to hold harmless, release, indemnify and forever discharge CMAC Dapo, its officers, directors and employees, instructors, agents and authorized representatives from any liability, claim or loss, including loss of property, damage, personal injury, death, or expense incurred by the Buyer (and/or Minor) and arising from the Buyer's execution of this Contract, participation in any program offered by the School, including but not limited to, any injury or damage caused by the negligence or gross negligence of the School, its instructors, Buyers, agents, employees, operators, or authorized representatives. The Buyer specifically understands and agrees that he/she (and on behalf of the Minor) is assuming the risk of any and all injuries that he/she may suffer or incur as a result of his/her participation of any program offered by the School, therefore buyer agrees and waives all rights for any legal actions or harm to the Buyer.
Your Rights under the Consumer Protection Act, 2002
You may cancel this agreement at any time during the period that ends ten (10) days after the later of the day you receive a written copy of the agreement and the day all the services are available. You do not need to give the supplier a reason for cancelling during this 10-day period.
In addition, there are grounds that allow you to cancel this agreement. You may also have other rights, duties and remedies at law. For more information, you may contact the Ministry of Consumer and Business Services.
To cancel this agreement, you must give notice of cancellation to the supplier, at the address set out in the agreement, by any means that allows you to prove the date on which you gave notice. If no address is set out in the agreement, use any address of the supplier that is on record with the Government of Ontario or the Government of Canada or is known by you.
If you cancel this agreement, the supplier has fifteen (15) days to refund any payment you have made and return to you all goods delivered under a trade-in arrangement (or refund an amount equal to the trade-in allowance).
I have read and understood this Waiver of Liability and all terms in this Training Agreement. I am aware that by agreeing to its terms, I waive any legal claims which might arise from my participation.
