MISCONDUCT AND INAPPROPRIATE BEHAVIOUR(S)

Purpose

  1. The following defines the many categories of Misconduct and inappropriate behaviour(s), and the process to follow upon discovery of such unacceptable conduct.

General

  1. While it is expected that everyone in the Dapo will behave in a professional manner and treat each other with dignity and respect, it does not always happen.
  2. Examples of misconduct and/or inappropriate behaviour in the Dapo include, however are not limited to:
    1. Conduct deficiency - failure to meet the established standard of behaviour found within the respective code of conduct, instruction or directives.
    2. Performance deficiency - failure to meet the established standard of performance found in the respective references.
    3. Unacceptable comments – pervasive, indecent, uncouth, crude, offensive, unwelcomed comments, innuendoes or jokes, etc;
    4. Unacceptable actions – staring or leering at someone; giving unwelcomed personal gifts; pestering, pursuing an uninterested individual, etc;
    5. Bullying – repeated abusive and offensive behaviour, which in some circumstances may involve inappropriate physical behaviour;
    6. Aggression and Violence – deliberate, unprovoked attack; whether innate or a product of frustration; use of physical force so as to damage or injure;
    7. Stealing – to take something not rightfully belonging to one without its owner consent.
  3. Misconduct of any nature, including inappropriate behaviour, reflects weakness in individual character, is inconsistent with the fundamental principles of conduct in the Dapo, and demonstrates a quintessential disrespect for the institution.
  4. All Dapo Staff and students are expected to:
    1. meet the established standards of behaviour found in applicable codes of conduct found in referenced documents;
    2. meet established standards of performance in the execution of their respective duties, tasks and responsibilities, based on their belt level, experience and position; and
    3. respect the dignity and values of all persons by treating them with respect and fairness at all times and in all places in accordance with the Canadian Human Rights Act.
  5. All must be held accountable for conduct and performance deficiencies resulting from factors within their control. Since such deficiencies are incompatible with the effective operations of the Dapo, they will not be tolerated.
  6. If a Dapo member suspects that misconduct or inappropriate behaviour(s), resulting from factors within the individual’s control have occurred; it is incumbent upon them to inform Sensei or Senpai soonest.
  7. Depending on the circumstances surrounding the issue, Sensei and/or Senpai may choose to take appropriate administrative or disciplinary action immediately; or in more complicated cases, they may choose to convene an investigative/ disciplinary committee accordingly, prior to addressing the matter.
  8. In all cases, should the alleged misconduct or inappropriate behaviour(s) be founded, the nature and severity of the consequences should be commensurate with the circumstances surrounding the incident, and all other relevant circumstances. Depending on the findings, any and all aspects of the Progressive Discipline Policy may be applied, accordingly.
